1. Acceptance of these terms
These Terms and Conditions (“Terms”) form an agreement between you and Immiforms (“Immiforms,” “we,” “us,” or “our”). They apply to the Immiforms website, application, related services, and any support or documentation we provide (collectively, the “Service”).
If you do not agree to these Terms, do not access or use the Service. Additional written terms may apply to a paid plan, enterprise arrangement, beta feature, or professional service.
2. The service
Immiforms provides tools designed to help Canadian immigration professionals organize clients, matters, forms, documents, deadlines, communication, billing, and reporting. The Service is a practice management tool—not legal advice, immigration advice, or a substitute for professional judgment.
You remain responsible for reviewing all information, forms, calculations, deadlines, filings, and client communications before relying on or submitting them.
3. Accounts and authorized users
- You must provide accurate account information and keep it current.
- You are responsible for safeguarding login credentials and using appropriate access controls.
- You must promptly notify us of suspected unauthorized access or a security incident involving your account.
- Your organization is responsible for its users, permissions, and activity under its workspace.
- You may not share individual credentials or allow access by anyone who is not authorized.
4. Subscriptions and payment
Paid features may require a subscription or other fees shown at purchase or in an order form. Unless otherwise stated, fees are charged in Canadian dollars, exclude applicable taxes, and are non-refundable except where required by law or expressly agreed in writing.
Subscriptions may renew automatically for the selected billing period until cancelled. You authorize our payment processor to charge the payment method on file. We may change pricing or plan features with reasonable advance notice, with changes taking effect at the next renewal unless otherwise stated.
5. Customer data
You retain ownership of the information, documents, and other content submitted to the Service by or for your organization (“Customer Data”). You grant Immiforms a limited right to host, copy, process, transmit, and display Customer Data only as needed to provide, secure, support, and improve the Service and to meet legal obligations.
You are responsible for ensuring that you have all necessary permissions and lawful authority to collect, upload, use, and disclose Customer Data, including client and personal information. Our handling of personal information is described in our Privacy Policy.
6. Acceptable use
You must not use the Service to:
- break the law, violate another person’s rights, or facilitate fraud or deception;
- upload malicious code or attempt to bypass security, access controls, or usage limits;
- access another customer’s data or account without authorization;
- reverse engineer, scrape, copy, resell, or commercially exploit the Service except as permitted by law or a written agreement;
- interfere with the integrity, availability, or performance of the Service; or
- use automated systems in a manner that creates unreasonable load or risk.
7. Ownership and feedback
Immiforms and its licensors retain all rights in the Service, including its software, design, documentation, branding, and content, excluding Customer Data. No rights are granted except the limited right to use the Service under these Terms.
If you provide suggestions or feedback, you allow us to use them without restriction or compensation, provided we do not identify you publicly without permission.
8. Third-party services
The Service may connect to or rely on third-party products, websites, payment processors, or integrations. Their terms and privacy practices apply to their services. Immiforms is not responsible for third-party services outside our control.
9. Availability and changes
We work to provide a reliable Service, but uninterrupted or error-free operation is not guaranteed. Maintenance, security events, internet failures, third-party outages, or circumstances beyond our control may affect availability. We may update, improve, discontinue, or restrict features where reasonably necessary and will provide notice when a material change affects paid use.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Immiforms disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
Immiforms does not guarantee the accuracy or acceptance of any government form, rule, deadline, calculation, automated output, or third-party information. You are responsible for professional review and compliance with applicable requirements.
11. Limitation of liability
To the maximum extent permitted by law, Immiforms will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity arising from the Service.
Immiforms’ total liability arising out of or relating to the Service will not exceed the amount paid by you to Immiforms for the Service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
12. Suspension and termination
You may stop using the Service at any time and may cancel a paid subscription according to the applicable plan terms. We may suspend or terminate access when reasonably necessary to address non-payment, a material breach, security risk, unlawful activity, harm to the Service or others, or a legal requirement.
Following termination, access to Customer Data may end. Export or retrieval options may be subject to the plan, technical limits, applicable law, and our retention practices.
13. General terms
We may update these Terms by posting a revised version and changing the “Last updated” date. We will provide reasonable notice of material changes. Continued use after the effective date means you accept the revised Terms.
These Terms, together with any applicable order form and the Privacy Policy, are the entire agreement about the Service. If part of these Terms is unenforceable, the remaining provisions remain effective. You may not assign these Terms without our written consent; we may assign them as part of a corporate transaction or by operation of law.
These Terms are governed by the applicable laws of Canada and the laws of the province or territory governing your written agreement with Immiforms, without regard to conflict-of-law rules.
